PrivacyGuard End User License Agreement

This End User License Agreement ("Agreement") is a legal agreement between you ("Licensee" or "you") and Andrew Rester ("Licensor," "we," "us") governing your use of the PrivacyGuard application, including the Windows and macOS builds and all associated files (the "Software").
By downloading, installing, or using the Software, you agree to be bound by this Agreement. If you do not agree, do not install or use the Software.
1. License Grant
Subject to your compliance with this Agreement and payment of the applicable license fee, Licensor grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on devices you own or control, for your personal or internal business use.
A single valid license key entitles you to use the Software on both the Windows and macOS builds.
Your license key is required for every download, update, and reinstall — store it in a secure place (for example, a password manager) so it is available if you get a new device or need to reinstall the Software.
2. Restrictions
You may not:
- Copy, modify, adapt, translate, or create derivative works of the Software;
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software, except to the extent such restriction is prohibited by applicable law;
- Distribute, sell, rent, lease, sublicense, or otherwise transfer the Software or your license to any third party;
- Remove, obscure, or alter any proprietary notices on the Software;
- Use the Software to build a competing product or service;
- Share your license key with any third party.
3. Ownership
The Software is licensed, not sold. Licensor retains all right, title, and interest in and to the Software, including all intellectual property rights. This Agreement does not grant you any rights to trademarks, service marks, or trade names of Licensor.
4. Privacy and Data
The Software performs all face-detection processing entirely on-device. No camera footage, images, or biometric data are transmitted off your device, stored persistently, or shared with Licensor or any third party. License verification uses only your license key — no usage or camera data is included or transmitted.
5. Updates and Support
Your license key entitles you to free updates to the current version of the Software at no additional cost — every download using a valid license key retrieves the newest published release. Licensor may, but is not obligated to, continue developing new features, patches, or major version updates; this Agreement applies to any such updates unless accompanied by a separate license.
If you lose your license key, contact support@privacy-guard.app. Support can retrieve and resend your license key after verifying your identity against the original payment record (for example, the email address or payment method used at purchase).
6. Disclaimer of Warranty
The Software is provided "as is," without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and noninfringement. Licensor does not warrant that the Software will detect every instance of an additional person viewing your screen, or that it will be error-free or uninterrupted. The Software is a privacy aid, not a security guarantee.
7. Limitation of Liability
To the maximum extent permitted by law, in no event shall Licensor be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, privacy, or profits, arising out of or related to your use of the Software, even if advised of the possibility of such damages. Licensor's total liability under this Agreement shall not exceed the amount you paid for the Software license.
8. Refunds
All sales are final once the Software has been downloaded using your license key. Downloading the Software using your license key is logged, including the associated payment record, and constitutes acknowledgment that the Software was delivered.
If you have not yet downloaded the Software, you may request a refund by contacting support@privacy-guard.app.
9. Termination
This Agreement is effective until terminated. Licensor may terminate this Agreement, and revoke your license key, if you breach any term of this Agreement. Upon termination, you must cease all use of the Software and delete all copies in your possession.
10. Governing Law
This Agreement is governed by and construed in accordance with the laws of the State of Arkansas, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in Arkansas.
11. Changes to This Agreement
Licensor may update this Agreement from time to time. Continued use of the Software after changes take effect constitutes acceptance of the revised Agreement. The current version is always available at privacy-guard.app/terms.
